Review of Ground Rules, Structure and Last Meeting’s Minutes

 

The minutes from the meeting of September 1, 2004, were reviewed.  There was one correction: The date in the header should have been September 1, 2004 instead of April 30, 2004. 

 

The minutes were accepted as revised.

 

New Business:

1.      Signing Bonus Calculation – 2040 hours vs. 2704 hours for Firefighters– The 2% Ratification pay will be based on 2704 hours for Firefighters.  Disposition of issue: Closed.

2.      Military’s Involvement in Administrative Procedures – The Union feels that it’s not necessary to have a state employee interviewed by a military person.  A clarification was requested as to when military personnel are allowed to interview state employees.  The agency structure was explained indicating that many state employees are supervised by military personnel.  The Union suggests that if an employee is interviewed by more than one military personnel, that employee seek private counsel.  If possible, the Union would like to see only the investigating official interview the employee since the Union has the duty to protect its employees.  In the future, prior to interviewing state employees, management and the Union need to work together to make sure employees’ rights are protected.  Disposition of issue: Closed.

 

Old Business:

 

1.      Physical Abilities Test – The draft was reviewed again for accuracy and to make sure all the changes that had been discussed at the last meeting were incorporated. 

a.      On page 1 of the draft under PROGRAM IMPLEMENTATION, Paragraph 2, the second sentence will be changed to follow the MOU and read: Each person who completes all of the evaluation stations on the first attempt will receive $300.00… 

b.      It was decided that the two minute rest period will be monitored by the test proctor. 

c.      It was also agreed that if a firefighter volunteered to take the test to evaluate it, they must retake the test for their official result. 

d.      Other changes to the test included:  Page 2, Item #8, Kaiser Sled only. 

e.      Page 2, the paragraph titled Firefighter Occupational Assessment Circuit Description will be changed to read:  The circuit consists of 10 simulated fire-fighting tasks that must be completed in a continuous and consecutive manner on a smooth surface.  Rest periods not to exceed two minutes total may be utilized during the test between tasks by walking or stopping.  Resting during a task will be construed as a break and is not allowed.  Walking between tasks permits the firefighter to recover their breathing pattern and allows them to cool down.  The tasks that make up the occupational fitness assessment circuit are as follows:

2.      Standardizing physical exam packet – Rich Mummey presented drafts of a standardized test result form, a standardized contract for services, a consent for release form and a procedure for handing physical results. 

a.      It was decided that the 1582 physical should be followed when preparing the statement of works and the contract.  Much discussion was had concerning changing the release forms and test result forms.  Rich Mummey will draft the changes and send to all present prior to the next meeting. 

b.      The question was asked who should pay for any follow-up testing that may have to be done after a firefighter has had his or her 1582 physical.  It was the general consensus that the employer should bear the burden.

c.      The Chiefs are still working on a statement of works.  They are to meet on December 1 to do this.  The language for the checklist will be taken from 1582.  Marva McCall and Jeff Freeman will send language for the scope of 1582 to be attached to the back of the statement of works that will include “These physicals will be conducted in strict compliance with 1582 which is attached and incorporated in this statement of works.”

d.      While discussing this issue, a transitional work program (TWP) implementation was discussed.  The agency has a draft TWP and will bring it to the next meeting and will be placed on the agenda.

3.      Honor Guard – Tabled until next meeting.  Disposition of issue:  Ongoing.

 

The next meeting has been scheduled for: 9:00 a.m. Preparation time and 10:00 a.m. meeting on Wednesday, February 16, 2005 at OCSEA.
